“E-Book Piracy is Ruining Publishing”

Are the pirates going to ruin publishing? The problem posed by e-book piracy is not new. It’s as old a publishing

I don’t advocate e-book piracy, but it’s time we got real about the effects. Publishers and other purveyors of old media have a lot invested in a system that paid well for them over the last Century or so.  Authors gave up control of their work and the publishers dictated how the we bought and read books (along with recorded music, broadcasting and any media). Since digital media hit the scene, they’ve been whining that their industry is doomed.. and quite likely it’s never going to be what it was in the 20th Century.

Will E-Book Piracy Ruin Publishing?

Not likely. As the price of duplication moves toward zero, there will be some who can’t depend on a system that worked for them in the past. If they haven’t read the signs over the last 30 years that digital content is making a perfect copy for next to nothing, and they are relying on printed books, they going to be hurting. But even if the big publishers completely went away, the books that have been published are here to stay, and wider distribution is good for the careers of authors.

Historical Proof of What E-Book Piracy Could Do

Almost as soon as there was publishing there was piracy… and publishers have been complaining ever since. In 1706 Edward Ward wrote:

Property of their Copies, has been of late, not only a Damage to the Trade in Generat, but a great Discouragement to Authors; for there are fo many Piratizing Printers, who lye upon the Catch, that no Saleable Poem or Pamphlet, of Twelve-pence, or Six-pence Price, can be started into the World, but the next Day yon shall have it Bastardized in White-Fryars, or Little-Britain; to the Injury of the Book-seller, and the Scandal of the Author, have it Bawld about for a penny or Two pence, nay, sometimes for a Half-penny, in every Gossipping Alley, amongst Porters Wives and Basket-Women, which we have great hopes will be prevented for the future, in the next Sessions of Parliament, and then we may hope for more of the fame Authors Writings.

STEALTH OF NATIONS: The Global Rise of the Informal Economy

This became the basis for copyright law petitions and all the laws that followed. But what of the poor authors who were damaged? In “Stealth of Nations: The Global Rise of The Informal Economy” Robert Neuwirth describes how these low priced books spread fast:

“an honest look at the history of trade shows that piracy wasn’t just a  form of trade; it was also a potent force that drove the growth of arts and culture. In particular, piracy helped expand literacy and impacted the Western intellectual tradition in some startling ways”

Neuwirth tells the story of a time when all commerce was assumed to be infected with piracy and how the raw capitalism benefited from rules.

But for how long?

Today, there are works that are held back to protect a copyright for the creator who has long since retired, huge disputes and huge corporations trying to hold on to their cash cows.

Some governance makes sense, but does the piracy end progress? Today, authors use books as calling cards, a front piece for business that benefits when more see it. As one of these authors, I don’t want someone to steal my work, but I do like to see that readers who can benefit get it.

Publishing isn’t going away. It IS going to to keep changing. In some ways don’t we all benefit from change.. even e-book piracy?

  • Three Settlements have been reached with certain publishers in an antitrust lawsuit filed by State Attorneys General about the price of electronic books (“E-books”).
  • The lawsuit claims there was a conspiracy involving three of the nation’s top publishers and others to fix and raise retail prices of E-books.  These three publishers have agreed to settle the lawsuit. A separate lawsuit with similar claims continues against two other publishers and Apple Inc.
  • If you purchased one or more E-books from April 1, 2010 through May 21, 2012 that were published by any of the five Publishers (listed in Question 2 of the FAQ’s), you may be eligible for a partial refund of the purchase price.
  • The Settling Publishers deny they did anything wrong, but have agreed to settle to avoid the cost and risk of a trial.
  • Your legal rights are affected whether you act or don’t act.  Read this notice carefully.

This is the competition out there for great books. The playing field is getting a lot larger.

What to Do When Your Manuscript Gets Rejected

Dealing with rejection by a publisher. Some say it’s an author’s worst nightmare. But it happens to thousands of manuscripts by thousands of authors every week of the year. An author pours his heart into a story and is convinced it’s going to appeal to everyone who reads it. Then he gets rejected by not one, not two, but five or more publishers. Are the publishers crazy? Or is his work truly awful? His manuscript probably wasn’t rejected for either of those reasons, but it still stings nonetheless.

If you submit a manuscript to publishers and it gets rejected, what are you to do? The first step is to revise your work and try to improve it. There are many ways to do this. Sometimes the publisher will tell you why your work was rejected and give you a place to start, but usually not. You can also seek the constructive criticism of trusted friends and fellow authors, and you can take an honest look at your work yourself. After you’ve revised, you resubmit. But what if this only results in more rejection letters? Is there anything else you can do?

Dealing with Rejection: The Self-Publishing Solution

You don’t need the backing of a major publisher to successfully sell your book. What you do need is drive and motivation. If you have the time and are willing to put forth the effort, you can self-publish. Self-publishing opens the door for many authors, and lots of them achieve great success and profit through self-publishing. Beyond self-publishing, there is a specific method that makes things even more possible for more authors: print on demand (POD). Print on demand is a way to self-publish without requiring a significant amount of money up front to purchase hundreds of copies of your book. It’s a way to self-publish in which your book is only printed when someone buys it. It’s that simple.

Why POD?
With POD you’re assuming a much less significant risk in self-publishing. If no one wants to buy your book, you aren’t out all of the upfront costs of offset publishing and left with a huge inventory taking up room in your basement. It helps you maximize your profits. POD publishers will also help you get your book listed on Amazon and available through brick-and-mortar bookstores. Best of all, most POD publishers won’t judge your book or reject it. They’ll print it for you, but it’s up to you to do the necessary marketing. If you don’t succeed, POD publishers don’t lose anything. There are lots of great POD publishers out there. Two of the major players are Lightning Source and CreateSpace. Rather than hoping that a major publisher picks you, with POD you have the luxury of choosing your publisher and creating your own book deal.

It’s very disheartening when your manuscript is continually rejected, but don’t forget that you have other options. You don’t necessarily need the backing of a major publisher or an agent to get your book out there and turn a profit. If you’re tired of getting rejected and are ready to just get on with things, self-publishing through print on demand may be just the thing for you.
